BANDERO WILL OBJECT TO QUEEN MARY SETTLEMENT
A company that insists it has been defrauded of development rights to the Queen Mary and surrounding acreage will be in Los Angeles bankruptcy court this morning to try to put another obstacle in the path of final sale of the lease to that property.
Bandero LLC says it has invested more than $12 million into Queen Mary property since purchasing 24 percent of QSDI — the company that held the lease for more than 10 years until filing bankruptcy in March 2005. It says it has been defrauded of its rights, first by QSDI CEO Joe Prevratil, and now by Save The Queen, a consortium headed by Newport Beach developer Jeff Klein, which successfully bid $43 million for the lease in August and is trying to close that deal.
Closure of the deal was stayed by an appeals court on October 19 due to a claim against QSDI by a company called AAC Shoreline. A tentative settlement with AAC Shoreline was reached Tuesday in which the company will receive a $1.15 million settlement. That settlement is scheduled to be considered by bankruptcy court judge Vincent Zurzulo this morning.
However, AAC Shoreline’s claim against QSDI was based on its relationship with Bandero, which hired the company to do some construction work. On that basis, Bandero reasons, its claims against QSDI ought to be valid, too.
