SECOND STREET SHOOTING CASE GETS CONTINUED

 

The state’s case against Anaheim resident Ernest Raymond Rodriguez Jr., who was shot several times by Long Beach police on May 28 in Belmont Shore while allegedly resisting arrest—then released from custody weeks later—was … continued again Monday in Long Beach Superior Court.

This is not uncommon.

The reason this time? Defense request. “I just got this,” Rodriguez’s defense attorney Mark Fredrick of Anaheim said Monday outside Department M, hefting an armload of case materials he’d just received.

The shooting, you’ll remember, happened five months ago.

A few minutes later, Fredrick sought and received a continuance from Judge Gary J. Ferrari.

Rodriguez, who was freed on bail while still recovering from his wounds, stood next to his attorney in a maroon sweater-vest, a maroon shirt with white stripes, and black pants, and answered simply “Yes” when asked if he waived his right to a speedy preliminary hearing.

    "then released from custody weeks later"?? You imply that something is amiss because he was released from custody. It's called bail. Except in rare instances, the law requires all arrested/charged individuals to have the opportunity to get out of custody on bail. It does not, in any way, point to a weak case, or some mistake on the part of authorities. I guess I should start reading you guys like Fox News...not really news, just an opinion rag...

    At least it's consistent that a anonymous person critical of the spotlight placed on the shooting incident in front of Legends is also critical of the spotlight placed on Sean Hitchcock's bulldozing of the wetlands. I hazard to guess that untruthful_franklin would be critical of anyone who questioned the outrageous conduct of Mayor Foster, Councilman DeLong, wetlands developer Tom Dean, wetlands destroyer Sean Hitchcock or any of the bar owners on 2nd street.

    Is it common for the prosecution to wait 5-months before delivering case materials to the defense attorney?

    The police reported Ernest Rodriguez was shot because he overpowered a police officer who was in fear of his safety. The description provided to the media claimed Mr. Rodriguez was 5’ 6” tall and weighed 300 pounds. The below link takes you to a facebook picture of Rodriguez. Does that look like a person who weighs 300 pounds? The police department’s credibility on this and other cases is indeed suffering.

    Mike,was there not a report somewhere on a earlier blog about this story that
    LBPD obtained the weight figure from the individual's drivers license???

    That is not correct. The weight listed on the individual's driver's license was 210 lbs. The police initially claimed his weight was 300 lbs. Several weeks later, the police reduced this estimate to 270 lbs according to Press Telegram articles. Apparently Mr. Rodriguez lost 30 lbs while in the hospital. Or maybe they removed 30 lbs of lead from his body. Not sure which it was. However, I suspect that by the time the law suit goes to trial, the police's description of Mr. Rodriguez's weight will be down to somewhere around 210 lbs.

    Its kind of like the single mother of three who was mowed down in the cross walk on Ocean Blvd last year by the Long Beach Police officer. The police steadfastly claimed the woman JUMPED in front of the polce car, implying that she was trying to commit suicide. Moreover, the police spokesperson's claimed that the officer was not exceeding the speed limit. The subsequent investigation by the family of the deceased woman found each of these police statements to be a lie. It was proven in court that the officer was exceeding 60 mph on Ocean Blvd early in the morning in the fog without either his siren or flashing lights on. Over a $million was paid to the family of the deceased.

    The police refuse to reveal the name of the officer who negligently killed a mother of three small children. I wonder if it is the same officer who allowed window breaking to escalate to a shooting. Nobody knows because the police refuse to release any of the information. Meanwhile, my three year old DUI made front page news at the Press Telegram. Go figure.
