REGISTERED SEX OFFENDERS SUE CITY OVER RESTRICTIVE HOUSING ORDINANCE

 

Remember when registered sex offenders became an issue last winter–around the time we all learned about those registered sex offenders who all lived in the same Alamitos Beach apartment building?

Remember how TV’s Dr. Phil McGraw came to town, (like radio’s John & Ken), and wound up doing a show about the situation?

Remember how neighbors were understandably very concerned about having so many registered sex offenders living in one place–and how Long Beach City Council passed an ordinance in March further restricting where they could and couldn’t live?

Well, now the Press-Telegram reports that three lawyers representing 35 registered sex offenders (unnamed in court documents) filed a lawsuit Tuesday targeting that very city ordinance.

The lawsuit “says the city’s sex offender ordinance violates Constitutional rights and is too vague,” the P-T’s Paul Eakins writes. “The measure builds on existing state law to restrict where sex offenders may live or loiter, but city officials suspended enforcement of the ordinance in April.”

” ‘Basically it’s not being enforced,’ City Attorney Robert Shannon told the P-T. ” ‘Why they chose to serve the lawsuit at this time is unclear to me.’ “

    Better yet, why did the city draft and enact an ordinance it apparently had no intent of enforcing? The threat of litigation loomed over this issue from the moment the city took notice. Why then did the city create an ordinance they apparently cannot or choose not to enforce? Didn't some well paid counsel review things?
